Terms & Conditions
1. Introduction

These Terms and Conditions set out the rights and obligations of users of the wholesalefx.co.uk Website and those of Wholesale Fx, whose registered address is at FX Works, School Road, Wales, Sheffield, S26 5QJ, United Kingdom in relation to the wholesalefx.co.uk Website and the services provided by Wholesale Fx through it. Your use of this Website is subject to these Terms and Conditions and by using this Website, you are deemed to understand and accept these Terms and Conditions.

5.3 All purchases made through such third party Websites will be subject to the third party's own conditions of sale and at no time is Wholesale Fx acting in the capacity of either agent, partner or otherwise for such third parties unless specifically stated.


6. Linking to Wholesale Fx

We welcome links to our site, subject to the following Terms & Conditions. By linking to Wholesale Fx you are deemed to have accepted them.

6.3 You may not imply an affiliation between your site and wholesalefx.co.uk without express written permission.

7.1 Wholesale Fx’s Privacy Policy forms part of these Terms and Conditions, and in accepting these Terms and Conditions you also give your consent to the way in which your personal data is handled, which will be in accordance with our Privacy Policy.
7.2 Wholesale Fx is not responsible for the privacy practices of any third party Websites which are referred to on or linked to the wholesalefx.co.uk Website. You accept that when you leave the wholesalefx.co.uk Website, whether by clicking on a displayed link to a third party Website or otherwise, the Wholesale Fx Privacy Policy ceases to apply. Wholesale Fx encourages you to read the privacy policies of each and every Website that collects personal information.

8.1 You acknowledge that all copyright, trademarks and other intellectual property rights in and relating to Wholesale Fx and the wholesalefx.co.uk Website are owned by Wholesale Fx or third parties. Trademarks of Wholesale Fx include, but are not limited to: Wholesale Fx, Sunbed Fx, The Sunbed Warehouse, Slim Fx and Tan Fx.
8.2 You must not copy, distribute, show in public or create any derivative work from the wholesalefx.co.uk Website without our prior written permission. Restriction is also placed on copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted material, in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise.

9. Making A Purchase

9.1 When you place an order to purchase a product from us through the wholesalefx.co.uk Website, this represents an offer by you to purchase a product from us which is only accepted by us when we take payment for the item(s).
9.2 For the avoidance of doubt, no contract will exist between Wholesale Fx and you until and unless we taken payment. The action of taking payment by us results in a binding contract existing between us and you.


10. Payment

10.1 Payment is to be made within 7 working days. This allows us to work efficiently and will keep your delivery time down to a minimum.
10.2 We prefer payment to be through Paypal (secure online ordering with all major credit and debit cards). Other accepted forms of payment are postal orders, personal cheques and credit cards (over the telephone) - please make all cheques payable to “Wholesale Fx”. Cash is also accepted, but at the buyer’s risk when sent through the postal system.
10.3 International bidders are welcome and again we prefer payment through Paypal. Payment may be in the currencies specified on the wholesalefx.co.uk Website, any queries with this, please contact us.
10.4 If for any reason your method of payment is declined, we will notify you by email or telephone. We will recheck your card details with you or ask for an alternative method of payment. If your card has been declined and we have been unable to obtain a response via email or telephone we will re-attempt to authorise payment again.
10.5 When sending payment by post, please include your name, purchase details and delivery address. Providing this information will avoid a delay in delivery.
10.6 We reserve the right to request that we receive payment from you before we supply any products to you.


11. Shipping And Handling

11.1 Shipping and handling is charged at the rate as specified on the wholesalefx.co.uk Website and is non refundable.
11.2 Shipping and handling are clearly stated at the outset and are non-negotiable - please contact us if you are an international bidder before bidding and we can provide you with postage costs


12. Delivery Time
12.1 Once payment is received, orders processed before 2pm are posted on that day. Orders made after 2pm are posted the following day, the majority of our items arrive within 3-4 working days.
12.2 All items are sent by 2nd Class Royal Mail Recorded Delivery where destined for mainland UK. If you require any additional insurance (e.g Special Delivery), please email us for a price before paying.
12.3 We cannot be held responsible for items lost in the post, but will endeavour to trace any items that are lost and recover costs from the Royal Mail, as all items are recorded delivery.


13. Return & Refund Policy

13.1 If you return goods to us, unopened, within 30 days of dispatch, we will refund the amount charged for the goods (but not the shipping charge). We advise you obtain proof of posting from the post office. 13.2 We shall only refund your money where: a) the goods arrive damaged or faulty, or, b) the goods have been incorrectly dispatched.
13.3 We regret that no refunds will be given on products already opened. This does not affect your statutory rights.

14. Cancellations

14.1 Orders are processed almost as soon as they are placed and it is not possible to cancel or change an order on the wholesalefx.co.uk Website once it has entered the dispatch process.
14.2 If you no longer want the item you ordered, please return the item to us in accordance with our Returns & Refunds Policy and you will receive a full refund for the price paid for the item(s).


15. Tax Charges

For orders made from the UK or the European Union, 17.5% VAT is included.


16. Ownership and title

All ownership, title and risk of loss and/or damage in the product you have purchased shall pass to you at the point and time at which such product(s) leave our premises.


17. Electronic communications

17.1 When you transact with the wholesalefx.co.uk Website or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the wholesalefx.co.uk Website.
17.2 For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
17.3 This condition does not affect your statutory rights.

18.2 You will be subject to the policies and Terms and Conditions in force at the time that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you).


19. Severability

In the event that any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.


20. Indemnity

You agree to indemnify us against all liabilities, claims and expenses that may arise from any breach of these Terms and Conditions by you.


21. Assignment

Wholesale Fx reserves the right to assign these Terms and Conditions and to assign or subcontract all or any of our rights and obligations under these Terms and Conditions. You may not without the written consent of Wholesale Fx, assign or dispose of these Terms and Conditions.


22. Events beyond our reasonable control

22.1 We shall not be responsible for any breach arising from a Force Majure. We will therefore not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control including but not limited to any statutory changes or ruling.
22.2 This condition does not affect your statutory rights.


23. Waiver

If you breach these conditions and we take no action, we reserve the right to use our rights and remedies in any other situation where you breach these conditions.


24. Entire Agreement

These Terms and Conditions include our Privacy Policy. Together they represent the whole agreement between us and you concerning the wholesalefx.co.uk Website and they replace all earlier agreements and understandings between you and us. Any person who is not a party to any agreement formed under these Terms and Conditions has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any terms of these Terms and Conditions.


25. Consumer Protection (Distance Selling) Regulations 2000

Upon placing an order with us through the wholesalefx.co.uk Website, you accept to revoke your rights under the Consumer Protection (Distance Selling) Regulations 2000.


26. Governing law and jurisdiction

These Terms and Conditions shall be governed and construed in accordance with the law of England and Wales, and any dispute arising between us shall be subject to the exclusive jurisdiction of the English courts save that nothing in this paragraph shall prevent or restrict either of us from pursuing injunctive relief from courts in other jurisdictions in respect of which either of us might otherwise be entitled.


27. Limitation of Liability

27.1 Our liability to you for breaking any of these Terms and Conditions is limited to refunding monies paid for items not received or those returned within the agreed time scales and in the required condition. We won't be liable for any other loss or damages, unless the loss or damages are caused by our negligence or our breach of these terms and conditions.
27.2 We do not accept liability for any errors and omissions and reserve the right to change information, prices, specifications and descriptions. We will endeavour to do our best to correct errors and omissions as soon as practicable after we become aware of them. We shall be under no obligation to dispatch an order for a product which has been advertised at an incorrect price but we shall give you the option to either cancel the order or confirm the order at the correct price.
